Help For Injured PA Workers
The workers’ compensation system in Pennsylvania is complex, but we make it manageable for you. Our attorneys fight at every stage:
- File your claim correctly. We file every form on time and cut off any excuse the insurer might use to hold back your benefits
- Challenge denial of benefits. If your employer files a Notice of Denial (Form LIBC-496), we fight back immediately.
- Demand total disability benefits. We push for weekly checks if your injury causes lost wages.
- Secure medical treatment. We make sure you receive the care you need, not just what the insurance company wants to cover.
- Defend you after an IME. We protect you when the insurer sends you to its doctor to declare you “fully recovered.”
- Represent you in hearings and appeals. We argue your case before Workers’ Compensation Judges, the Appeal Board, and the Commonwealth Court.
- Negotiate settlements. We fight for lump-sum settlements only when they serve your best interest.
The PA Workers’ Compensation Process
@thwesq
When you know the steps, you can better protect your rights. Here’s how the process unfolds:
- Report your injury right away. The law gives you up to 120 days, but waiting puts your claim at risk.
- Employer reports the injury. Within 7 days of a disability, an employer must file a First Report of Injury. They must file this form with the Department of Labor and Industry.
- Insurer decides within 21 days. The insurance company must accept or deny the claim within 21 days. This starts when the employer gets notice of the injury.
- File a Claim Petition if denied. If the insurance company denies your claim, we fight for you in court.
- Appeal if needed. We have handled many appeals and have made law in PA from our work.
Real Example: We Set Precedent That Protects Workers
In the case of Wilgro Services v. WCAB (Mentusky), our firm fought for an injured worker fighting a denied claim. The worker jumped from a roof after his ladder disappeared. The employer tried to say the worker acted recklessly and didn’t deserve benefits. We fought back and showed that Pennsylvania’s workers’ comp law protects injured workers, even if they made a mistake.
The Commonwealth Court agreed and confirmed that workers keep their benefits in tough situations. This published opinion created controlling law in Pennsylvania. It shows the level of advocacy we bring to every case.
Common Situations Where We Step In
You should call us immediately if you face any of these challenges:
- Your employer insists your work related injury has nothing to do with work.
- The insurance company delays or denies your wage loss benefits.
- Your employer pressures you to return to work before your doctor clears you.
- An IME doctor claims you recovered even though you still struggle.
- The insurer dangles a settlement that doesn’t cover your needs.
- Fired while on light duty.
- Insurance carriers playing games or downplaying an injury.
- Adjuster threatens your workers compensation benefits.
- Insurer refuses to pay all wage losses and medical benefits.

Frequently Asked Questions
Do I need a lawyer to file a workers’ comp claim?
Yes. You can file alone, but the insurance company will have lawyers. You deserve one too.
How long do I have to report a work injury in Pennsylvania?
You should report it immediately. The Act allows up to 120 days, but every day you wait hurts your claim.
What happens if my employer denies my claim?
You file a Claim Petition. If the insurer denies your claim, we take it to court and fight for your benefits.
Can I settle my case for a lump sum?
Yes. Many cases end with a Compromise & Release agreement. We negotiate to make sure you receive what your case is worth.
What does a workers’ comp lawyer do?
We file. We fight. We go to court. We get you care and wage checks. And we stop the insurer from pushing you around.
What if my employer doesn’t have workers compensation insurance?
The UEGF pays your benefits — but the deadlines are tight. A lawyer makes sure you don’t lose your claim.
