Understanding Workers’ Compensation in Pennsylvania
Pennsylvania workers’ compensation helps injured employees with financial support after work-related accidents. This system ensures that injured workers receive medical care and lost wages related to their to work injury. Understanding the PA Workers’ Compensation Act is a necessary step to obtaining a favorable result.
To get workers’ comp in PA, an employee needs to have a work-related injury or illness. This includes both physical injuries and occupational diseases.
Workers’ Compensation Benefits in Pennsylvania Cover a Range of Needs
- Medical Care: Your employer must pay for all medical treatment related to the work injury or illness. Workers’ Comp has no out-of-pocket cost to the injured worker.
- Lost Wage Compensation: If an injury or illness prevents an employee from working, workers’ compensation provides partial wage replacement, ensuring financial stability during recovery.
- Specific Loss Benefits: Compensation for the loss of specific body parts, scarring, or disfigurement. Scarring and disfigurement of the head, face, and neck usually requires a Workers Compensation Judge to obtain compensation.
Claim Process for PA Benefits
The process begins when an injured worker notifies their employer of the injury. An employer then files a claim with their workers’ compensation insurance. The injured worker must provide notice of the injury within 21 days to receive all compensation the law provides. If the employee does not report the injury within 120 days, they may lose all rights to compensation.
An employer must accept or deny liability for the injury within 21 days of receiving notice of the injury. If the employer fails to do this, the injured worker can file for a penalty. However, if you receive a Notice of Workers’ Compensation Denial (LIBC-496) you should speak to a lawyer immediately.
If you receive a Notice of Temporary Compensation Payable (LIBC-501), review it carefully. Similarly, if you get a Notice of Compensation Payable (LIBC-495), make sure the insurance company gave accurate information. Routinely, insurance companies report the wrong wages, downplay an injury, or don’t pay lost wages on these forms.
A lawyer can correct these issues.

Denied Claims
Insurance companies deny a growing number of claims. A skilled lawyer can fight these denials, appealing the decision and fighting for you. Research shows workers receive more benefits if they pursue a denied claim.
Disputes with Insurance Companies
Insurance carriers try to pay as little as possible. Philadelphia workers’ compensation attorneys make sure the insurance carrier doesn’t try to cheat the system.
Incorrect injury description
Insurance companies love to treat every claim as a minor injury. We see insurance carriers describing serious injuries as strains or bruises on a daily basis. This can lead to high medical bills for injured workers when they deny more costly treatment as “unrelated”. A lawyer can take the insurance company to court so your claim includes everything it should.
